If you plan to place materials on Tisch Library reserves for spring 2011 courses, please observe the Tisch faculty guidelines found at http://www.library.tufts.edu/tisch/tisch_reserve_place.htm. Deadlines for submitting reserve lists are noted below. Reserve lists are processed in order of receipt. We expect all lists received by the deadline will be ready for the start of classes January 20, 2011.  Reserve statistics from past semesters indicate that, on average, only 15% of a semester’s reserve lists are received by the deadline.  Late submission can delay processing and student access to course materials.

Faculty begin securing publisher permissions for Spring 2011 reserve. Securing permission can take up to 8 weeks.

Submit requests for materials that need to be purchased for Reserve.  The purchase, receipt, catalog and reserve processes for new materials may require 6-8 weeks.

The University’s Policy on Fair Use of Copyrighted materials advises the Tufts Community to be mindful of copyright restrictions imposed by the copyright laws as well as the rights conferred by the fair use exemption to the copyright laws, and we are expected to comply with these laws.  A Fair Use website at http://www.library.tufts.edu/fairuse/ supplies guidance in compliance by providing the policy on fair use, pertinent FAQs, faculty resources, statutes and guidelines, links to other fair use web sites and tutorials.  Tisch Library encourages faculty to review the 4 fair use factors and, whenever appropriate, to secure publisher permission.  In response to AS&E faculty requests, Tisch Library has created a web page at http://www.library.tufts.edu/tisch/fair_use with links to tools, such as a Copyright Decision Tree to assist the faculty in determining when permission is needed; Ulrich’s, for publisher contact information; recommendations for obtaining publisher permissions, which contains advice about obtaining permissions; a web based publisher permission form or an all-purpose sample publisher permission letter that may be used by faculty members to obtain permissions from publishers; and retention of copyright. The role of the library is to educate, not enforce.

In planning for reserves for future courses, you might want to take into consideration that all Tisch Library database licenses allow access to the databases and some support direct links at the article level. You can provide these article links to your students in addition to or instead of placing items on reserve. The library has drafted the following policy on publishers’ permissions and reimbursement: The library prefers to purchase a book rather than pay for publishers’ permissions. Tisch Library pays publishers’ permissions only for materials placed on Tisch Reserve. Tisch Library does not pay for course pack permission.  The Library continues to gather information on the cost of publishers' permissions so has not established a limit for publisher permissions for materials to be placed on Tisch Reserve individually or collectively.  It is important that faculty get cost estimates for each permission and weigh the cost to the teaching value.  In some cases the publisher's cost may exceed the teaching value in which case faculty are encouraged to substitute other resources where cost does not exceed value. Faculty members need to consult with their subject bibliographer (http://www.library.tufts.edu/tisch/refcoll_directory.htm) before ordering any single publisher permission that exceeds $50.00.  Bills received for permission costs for materials placed on Tisch Reserve may be submitted to Tisch Library Reserve for direct payment to the publisher.

Please provide complete information including call numbers for Library owned titles. Omitted information delays processing.
